DMCA Notice

We respect the intellectual property rights of others, and we expect our users to do the same. You should only upload content to our Service that is yours or that you’re otherwise authorized to post.

In keeping with the Digital Millennium Copyright Act (DMCA) and other applicable copyright laws in other jurisdictions in which we offer our Service, we will remove content that’s identified to us by the copyright owner through a valid notice of copyright infringement (DMCA Notice).

What you can do

If you’re a copyright owner or authorized to act on behalf of one, you can report alleged copyright infringements to UpStudy by emailing to [email protected]. When we get your DMCA notice, we’ll take whatever action we think is appropriate, which may include removing the reported content from UpStudy.

To file a DMCA Notice with us, Copyright Owner or the designated Agent must:

  1. Provide an electronic or physical signature of the Copyright Owner or the designated Agent.
  2. Provide a description of the copyrighted work that is claimed as infringed.
  3. Identify where the infringing copyrighted work is located on the UpStudy website.
  4. Provide sufficient contact information such as name, address, phone number and email address.
  5. Provide a statement that they have good faith belief that the infringing use is not authorized by the Copyright Owner, his designated Agent or by law.
  6. Provide a statement under penalty of perjury that the information in the notice is accurate and that they are the Copyright Owner or an authorized Agent to act on behalf of the Copyright Owner.

Copyright Owner or its designated Agent who make misrepresentations with regards to the copyright infringement may be liable for damages incurred as a result of removing or blocking the alleged copyrighted work.

What will we do

If we remove content in response to a DMCA notice, we may notify the copyright owners so they have the opportunity to know their copyrights are well protected. We may also send a complete copy of the notice to others, as appropriate.

Counter-Notice

If you believe that a notice of copyright infringement has been improperly submitted against you, you may submit a counter-notice to UpStudy via the contact information provided above.

Please be aware that there are legal and financial consequences for fraudulent or bad faith counter-notices. Before submitting a counter-notice, make sure you have a good faith belief that we removed the content in error, and that you understand the repercussions of submitting a false claim.
